Double-murder accused Chris Kahui has had his bail revoked and will remain in custody, his lawyer has confirmed.
Kahui is due to stand trial next April for the murder of his 3-month-old twin sons Chris and Cru in June last year. He denies the charges against him.
Kahui was remanded in custody in late August after he breached his bail by drinking alcohol and being in the presence of children at a social gathering.
However, he had been due to be released from jail on Tuesday after being one of the first to take advantage of new bail laws at a hearing last week.
But his lawyer Lorraine Smith today confirmed reports that Kahui would remain behind bars.
"I spoke to him 10 minutes ago and he was quite tearful but he understands the situation," Ms Smith said.
She said there can not be anymore hiccups.
"It's too stressful for his lawyers," she laughed.
She said until an appropriate place Kahui could be found, he was better off in custody.
"We don't want him to be in a position where there's a possibility for further breaches," Ms Smith said.
A group of Marist brothers have been contacted and asked for help, Ms Smith said.
"The community is having a hui and deciding where he can live," she said.
Chris and Cru Kahui died five days after they were admitted to Starship Hospital. They had head injuries and broken ribs, and one had a broken femur.
