Two Christchurch High Court judges have been deliberating for a week now, after David Bain's lawyers presented their case as to why the retrial should be stopped.
All the details were suppressed.
The decision was supposed to be released today - but a memo from the High Court in Christchurch says it will now be Monday at the earliest.
If the trial goes ahead, it is due to start next Friday.
