The decision whether to take bailed murder-accused David Bain back to court now rests in the hands of the Solicitor General.
Detective Senior Sergeant Kallum Croudis, the Dunedin officer in charge of the Bain file, told The Otago Daily Times police had made their recommendation to Crown Law yesterday.
He would not say whether or not police had recommended for Bain to return to court to face another trial for the murders of his parents and three siblings in their Dunedin home in 1994.
Police spent the last three weeks revisiting their evidence, after Bain's original conviction for the murder of his father, mother, two sisters and brother were quashed by the Privy Council last month.
Bain, who was 23 at the time of the killings, has maintained his innocence throughout his 13-year imprisonment.
The London-based Law Lords ordered a retrial, ruling a substantial miscarriage of justice had taken place.
In the interim, Bain has been bailed to the Waikato town of Te Kauwhata, where he is staying at the farm of his chief supporter, former All Black Joe Karam.
