The Privacy Commission has not been able to settle a complaint from a mother who said a school holiday programme published a photo of her daughter without her consent.
The Privacy Commissioner received a complaint from the mother who said that her daughter's privacy had been breached.
The mother said she did not want any photos of her daughter published because in the past they had both been harassed by her ex-partner.
She ticked 'No' when asked if it would be okay for her daughter's photo, name or video to be published in a newsletter.
Her daughter's photo ended up being published in a local newspaper.
The mother told the commissioner she had been advised by police not to disclose any information that would enable her former partner to contact the family.
Her daughter said since the photo had been published she no longer felt safe.
The mother suggested $500 in compensation for her daughter.
However, the non-profit organisation said it was unable to pay that much compensation.
The matter could not be settled by the commissioner so the mother was advised to refer the case to the Director of Human Rights Proceedings.
The ruling was reported in the commission's newsletter, Privacy Word.
