A Brisbane Facebook troll who was jailed for plastering child pornography on tribute sites for two dead schoolchildren has been denied bail pending his appeal over the sentence.
Bradley Paul Hampson, 29, made his bid for bail in the Supreme Court in Brisbane today, applying for release until the Court of Appeal assesses what he claims is an excessive three-year sentence handed down in the Brisbane District Court in March.
The judge ordered Hampson serve 12 months behind bars after he pleaded guilty to one count each of distributing child exploitation material and possessing child exploitation material, and two counts of using a carriage service to menace, harass or cause offence.
Hampson posted offensive comments and pornographic images on social networking pages honouring 12-year-old Elliot Fletcher and eight-year-old Trinity Bates.
Elliot died in February last year after being stabbed in the chest during a schoolyard fight.
Trinity's body was found in a drain near her family home at Bundaberg in the same month.
More than 9000 people joined the tribute pages, posting messages of condolence.
However Hampson instead posted digitally altered images of the children along with vulgar messages.
Barrister Carl Heaton SC on Tuesday urged Justice Jean Dalton to conditionally release his client, arguing Hampson would otherwise have already served a substantial portion of his sentence by the time the appeal is heard.
However, Justice Dalton refused the application after hearing details Hampson had breached his bail repeatedly while awaiting sentence for the Facebook attacks.
The court heard he breached his bail conditions by failing to report to police, failing to reside at his nominated address and accessing the internet.
