Police have lost an appeal against a court order to pay $5000 to a prison guard for breaching her privacy in relation to a fraud probe.
In February, police were found to be in the wrong for telling Hawke's Bay prison guard Carol Whatuira's employer she was under investigation.
Whatuira was charged with using a document and given diversion because she lied to protect her sister-in-law, who was carrying out an insurance scam.
