A man convicted for the murder of his tetraplegic friend has had his conviction set aside by the Court of Appeal.
Eric Neil Smail was jailed for life in 2006 for the murder of the tetraplegic friend he was caring for, Keith McCormick.
In a judgment released yesterday the court granted Smail leave to appeal, set aside his conviction and remitted the case to the High Court at Christchurch for a trial.
