Yesterday the Herald published an article headlined 'Waipareira Trust faces big legal bill'.
The article may have implied that law firm Chen Palmer had charged inappropriately high legal fees to the Waipareira Trust, and reported Mr John Tamihere as saying that the High Court judge had recommended that the trust refer the matter to the District Law Society for review.
The Herald accepts that this is incorrect. The High Court made no recommendation. It directed that the trustees could apply to the District Law Society for a revision of costs incurred by either party if any of the trustees were concerned.
The Herald also accepts that Chen Palmer's fee for defending the trust in recent High Court litigation was $86,521.10 plus GST and disbursements.
The $140,000 referred to in the article was for fees, GST and disbursements for the High Court litigation and also for a range of other unrelated work.
The Herald apologises for these errors.
