Conservation Minister Chris Carter will not appeal a High Court decision overturning his veto against a Whangamata marina development.
He has also decided to delegate the next decision on the marina application to Environment Minister David Benson-Pope.
The Whangamata Marina Society went to the High Court after Mr Carter vetoed resource consents for a proposed $10 million 205-berth marina at the small coastal town of Whangamata in the Coromandel.
Justice John Fogarty ruled in favour of the society, directing Mr Carter to set aside his decision and reconsider the case.
Justice Fogarty said Mr Carter had gone beyond his powers and made mistakes when he vetoed resource consent for the marina.
