Two Brazilian students in New Zealand on temporary visas have been charged with the rape of a young woman in a 2 1/2-hour ordeal during her birthday party celebrations.
The 19- and 21-year-old men have been accused of rape, two counts of sexual violation and indecent assault, and a further charge of abduction, against a 22-year-old woman on Labour Weekend last October.
The men were in the Auckland District Court for a one-day depositions hearing last week. Their families sat in the back of the court room with an interpreter. The pair will stand trial.
Police allege the Brazilians approached the woman as she sat outside a Karangahape Rd bar in the early hours of Sunday morning, getting some fresh air after a night of dancing.
She had left her handbag inside the bar with her boyfriend, as she was feeling nauseous from drinking alcohol and taking party pills and ecstasy tablets during the night's celebrations.
The police summary of facts alleges the two defendants hailed a taxi and took the complainant - who was in a stupor - back to their inner-city apartment.
According to the summary of facts, police allege the duo stripped the woman naked and then raped and performed indecencies on her for at least 2 1/2 hours.
Police say the complainant faded in and out of consciousness, and could not move or protest except to say "stop, stop, I have a boyfriend".
Eventually the woman was allowed to dress and leave.
The accused men, who had been in the country only two months, have denied the charges and said the sex was consensual.
