A Christchurch businessman will not have to pay $100,000 to the 13-year-old boy he hit for ogling his partner's breasts.
The teen's mother asked for the money from the man in return for not bringing a private prosecution after police decided not to charge him.
But the man refused to pay the cash.
In the High Court in Christchurch Justice Lester Chisholm ended the nearly two years of legal proceedings by rejecting the mother's bid to put the businessman on trial.
He ruled the private prosecution was an excessive and delayed response that was out of proportion with the incident.
The judge ordered the businessman's name to be permanently suppressed. The name of the boy and his family is automatically suppressed because of his age.
