A war veteran will have to wait five more weeks to find out if the teenager accused of bashing him will stand trial after a debate about name and image suppression.
A depositions hearing to decide if the 18-year-old accused of bashing Eric Brady outside the Papatoetoe RSA on February 18 would stand trial was due to proceed at Manukau District Court yesterday.
But after two justices of the peace decided to lift name and image suppression, the teen's lawyer, Amit Malik, appealed to the High Court, meaning suppression would stand.
Mr Malik then asked for an adjournment, saying the outcome of the High Court's decision on suppression would affect the way the depositions hearing would proceed. The JPs agreed to the adjournment.
Attempts were made to have the depositions hearing late next month but schedule clashes meant it was put off until July 2.
Most members of Mr Brady's family did not want to comment, although one said she was angry.
Mr Brady's jaw was broken in at least two places and he was badly bruised about his face after the attack.
The accused, who faces charges of causing grievous bodily harm, being armed with a knife and stealing Mr Brady's keys, was remanded in custody.
