Lawyers for David Bain have one last chance, starting this morning, to have his retrial thrown out.
After serving 12 years in prison, David Bain was granted the retrial by the Privy Council in May 2007.
He has been on bail since and is due to be retried next month for the murders of five family members.
His lawyers claim there is enough evidence to have the retrial aborted and two judges at the High Court in Christchurch will consider their case at a hearing which gets underway today and is expected to take a week.
The evidence is likely to be suppressed.
