The High Court at Christchurch has set down a week to hear David Bain's bid to have his new trial thrown out.
Bain, found guilty in 1995 of murdering five family members at his home in Dunedin, was freed from prison in May 2007 after the Privy Council quashed his convictions.
New Zealand's Solicitor-General David Collins later ordered that the case should be retried.
Bain's new trial is due to start on March 2.
Much of the stay hearing, which starts on Monday, is expected to be suppressed.
