The Court of Appeal has overturned an Employment Court ruling that bus drivers who gave intention of notice to strike but then continued working do not have to be paid.
The New Zealand Tramways and Public Transport Employees Union challenged the ruling that Mana Coach Services did not have to pay the drivers following the 2007 dispute.
The Court of Appeal today ordered the two parties back to the Employment Court to resolve the issue.
