Police say nothing can be done to keep a woman with an extensive criminal record and history of drug abuse from re-offending here once she is deported from Australia.
Patricia Carol Toia is being held at Villawood detention centre in Sydney awaiting deportation to New Zealand, after Australia's Administrative Appeals Tribunal decided she did not pass the character test needed to keep her visa to live in Australia.
The 26-year-old has lived in Australia since her family moved there when she was 14 months old.
Toia will return with all the rights of a normal law-abiding NZ citizen, despite a 30-page criminal record.
Under NZ law, Toia is not subject to police checks or supervision and a driving disqualification in Australia until 2053 will not apply here because there is no transtasman agreement on the supervision of deported or extradited criminals.
NZ First leader Winston Peters says Australia should not be dumping its problems on New Zealand.
"I don't think we should be forced to take her back, because she learnt all her adult ways in Australia."
