Auckland International Airport is disappointed that the Craigie Trust intends to take a dispute over land to the Supreme Court.
The airport operator said it would oppose a Craigie application for leave to appeal to the Supreme Court and would strongly defend any appeal if leave was granted.
A Court of Appeal decision in December 2009 upheld the earlier High Court ruling in favour of Auckland Airport.
The dispute is about 36ha of land acquired under the Public Works Act from the trust.
The act obliges land to be offered back to the former owner if no longer required for public works.
