Head of the Security Intelligence Service Dr Warren Tucker has said Ahmed Zaoui is no longer a security risk.
Mr Zaoui, a former Algerian MP, fled to this country in 2003 and was held in prison for two years after the Security Intelligence Service declared him a threat to national security.
Mr Zaoui has been struggling to stay in New Zealand and sought refugee status.Mr Zaoui's wife and children are in South East Asia.
The Algerian refugee was released from jail in 2004. A four-week hearing into the Security Intelligence Service (SIS) assessment that the once-elected Algerian MP posed a security risk to New Zealand was held in Auckland starting in July.
