The family of doomed fishing boat captain Frank William "Billy" Tyne is suing the makers of the film The Perfect Storm.
Tyne's wife and two daughters filed a lawsuit against Time Warner Entertainment, contending that Tyne, played by George Clooney, was cast in a negative light and that their privacy was violated.
"Fiction as fiction is protected speech. Fiction masquerading as fact is not," said the family's attorney, Stephen J. Calvacca.
Time Warner said it did not need permission from Tyne's family to make the film and denied that the portrayal was negative.
Bring It On, a spoof comedy about rival high school pep squads, had a second weekend at the top of the United States box office. The other top earners were: 2 The Cell, 3 Space Cowboys, 4 The Art of War, 5 Highlander: Endgame, 6 What Lies Beneath, 7 The Original Kings of Comedy, 8 The Replacements, 9 Nutty Professor II, 10 The Crew.
