Nash was due to appear in Auckland District Court on March 9 to face the charges but never showed up and a warrant for her arrest was issued.
The following day, Kirby revealed on Facebook Nash had left the country with the couple two daughters, Honey, 5, and Lola 4.
"Put quite simply this is a really hard time for me and my family right now. My ex-wife has left the country and has taken our children with her," Kirby wrote.
Nash, who recently came clean about her high-profile battle with alcoholism, told Woman's Day the primary reason she left the country was exhaustion.
"Exhausted from dealing with a dysfunctional relationship. Exhausted from trying so hard to fix the mess I'd found myself in. Exhausted from constantly having the rug pulled out from beneath me. I just couldn't do it anymore."
She said Kirby had agreed with her when she told him she couldn't live in the same country anymore and was supportive of her decision to go to Australia.
According to Nash, Kirby only claimed she had fled the country with their daughters when it had become clear their relationship was over.
"I obviously loved that man for a long time. If he called me tomorrow and said, 'I'm sorry - it was hard for me to deal with,' I would work out a way for him to see the kids. It will always be an open door."
After her departure was revealed, details of her troubled past began to emerge including debts left to Auckland landlords and a liquidated company.
It was also revealed by the Weekend Herald the Auckland model had a second identity.
Tenancy Tribunal judgments obtained by the Weekend Herald revealed that in the past three and a half years, Ms Nash had been ordered to repay former landlords more than $9000 in unpaid rent and utilities.
In response to the allegations, Nash said she had offered to pay one of them in instalments but her offer had been declined. She said if the landlords were to come to her and ask her to sort out the outstanding money she would.
As for claims she owed creditors $8556.04 after her company Delivered Nutrition went into liquidation, the model said she had sold the rights to the liquid food company and the debt along with it. Nash said she was no longer responsible for the outstanding amount.
A border alert has been placed on her passport and the model could face being arrested if she returns to the country.
"Is it heart-breaking I can't come home because there is a border alert out for me? Yes, it's horrific but if I ended up in prison, who would look after my kids? They need me more than anything."
