Sideswipe Competition - Terms and conditions

Information on How to Enter and all details on the website form part of these Terms. To the extent of any inconsistency, the Terms below prevail. By entering, you accept these Terms.

1. Entry is open to NZ residents only. Anyone employed by (and any immediate family member of someone employed by) APN New Zealand Ltd, Air New Zealand and any agencies associated with these companies or with the promotion and Herald retailers are ineligible to enter. APN is APN New Zealand Limited (and its related companies). If the winner is under the age of 18 years the prize(s) will be awarded to the winner's parent(s) or guardian(s).

2. How to send a submission: submissions are to be emailed to ana.samways@nzherald.co.nz and need to include the entrant's full name and day-time phone number.

3. Entries must be received by The New Zealand Herald between 2pm on Thursday April 5 and 11.59am on Thursday April 12 2012.

4. The winning entry will be the best submission that has been received between 2pm on Thursday April 5 and 11.59am on Thursday April 11 2012 as judged by a representative of APN and will be notified by telephone. The New Zealand Herald's decision is final and no correspondence will be entered into. The winner will be announced in The New Zealand Herald on Friday April 13 2012.

5. There will be one (1) winner and the one (1) winner will win return "The Works" air fares for four (4) people (travelling together) to either Sunshine Coast, Brisbane, Gold Coast, Sydney or Melbourne, Australia from Auckland, New Zealand with Air New Zealand. Travel is on Air New Zealand operated services only, seats are limited and are subject to availability and close out dates may apply.

6. Any relevant transfers, airport, departure or government charges are at the traveller's expense.

7. Bookings must be requested at least 14 days before proposed departure date and tickets are non changeable once issued. Travel is non transferrable or redeemable for cash.

8. Travel is not eligible for any frequent flyer (including Airpoints) accrual, upgrades, companion redemption or credit of tier status.

9. All prize travel will be subject to Air New Zealand's Conditions of Carriage, to view visit airnewzealand.co.nz

10. All out of pocket expenses, accommodation, meals, insurance, passport fees, visas where applicable, transport to and from departure point, transfers and all other ancillary costs are the responsibility of those persons travelling.

11. The flights must be taken between 1 May and 29 June, 16 July and 28 September, 15 October and 30 November 2012.

12. Air New Zealand will book flights and will provide the winner with a detailed itinerary.

13. The winner and their travel companions must ensure that their passports have a minimum validity of six months before travelling and any visa requirements are the responsibility of the winner.

14. Compliance with any health or other government requirements is the responsibility of the winner and their travel companions.

15. The winner will be notified by phone. APN's decision is final and no correspondence will be entered into. Prize cannot be exchanged for cash, credit or service and no exchange communications will be entered into.

16. Neither APN nor Air New Zealand or associated partners are liable for any loss, damage or injury (including without limitation indirect or consequential loss) suffered by any person in connection with the promotion or any prize, except for any liability under the Consumer Guarantees Act 1993 or other liability that cannot be excluded by law.

17. APN and Air New Zealand reserve the right at their sole and absolute discretion to withdraw, cancel, suspend, modify and/or recommence this competition at any time, including if any their ability to fulfil their obligations is limited at any stage by any form of technical failure or other circumstance outside their control.

18. All entries are deemed received at the time of receipt by APN and NOT at time of transmission by the entrant. APN's records are conclusive as to time of receipt. Late, lost, stolen, misdirected, illegal, incomplete, illegible, damaged, reproduced, or altered submissions are invalid. APN is not responsible for such entries nor for any error, technical malfunction, loss, omission, communications delay or failure.

19. Entrants are identified by the email address used to submit the entry. Any prize won will be awarded to the holder of the email address (or that person's parent/guardian) from which that entry was submitted. APN takes no responsibility for disputes resulting from entries submitted using an email address belonging to any other person. Entries become the property of APN and APN may disclose all personal information relating to the entries to Air New Zealand. In accordance with the Privacy Act 1993, APN collects personal information and APN holds personal information to conduct the promotion, notify prize winners, and verify prize winners' identities. 20. Failure to provide all requested personal information may result in the entry being invalid.

21. APN shall have the right to store electronically any photos or details that relate to the entry submission and to use the images or entry details free of charge in any of their publications.

22. Each entrant agrees that, if he or she wins a prize, his or her details (including name, suburb/town, and photo) may be published in the Herald (print and/or online) and used for other publicity purposes.
