According to the documents the masseur believed that Spacey was trying to kiss him and Doe attempted to back away but Spacey grabbed his genitals and said seemingly said something about performing oral sex on him.
Doe said that he proceeded to grab his massage table before fleeing the residence.
He is now suing the former House Of Cards star for sexual battery, battery, assault, and false imprisonment.
This comes just weeks after Spacey and and Steven Seagal won't face charges for alleged sexual assaults that took place more than 25 years ago, according to the Los Angeles County D.A.'s office.
Legal documents from the L.A. County District Attorney state that neither will be charged in cases that stem from allegations from the early 90s.
For both cases, the statutes of limitation expired in the late 1990s.
The Los Angeles County Sheriff's Department had been investigation allegations made in 1992 against Spacey related to sex-crimes.
A man claimed that Spacey forced himself onto him in West Hollywood and raped him, according to the District Attorney's worksheet.
'The reporting party alleged that he was the victim of a sexual assault by the suspect in 1992,' the worksheet explained.
'The allegation is outside the statute of limitations, therefore, an analysis of the strengths and weaknesses of the evidence is not warranted and prosecutor is declined.'
Spacey is still under investigation for a case prosecutors brought forth last month.
The Oscar winning actor was said to have sexually assaulted a man in Malibu two years ago, according to the Los Angeles County Sheriff's Department.
In the Seagal case that was dropped, an alleged victim claimed that she was raped by the actor in 1993 when she was just 18.
'The statute of limitations expired in 1999. Therefore, an analysis of the strengths and weaknesses of the evidence is not warranted and the matter is declined,' the worksheet explained.
The D.A.'s office also has one more case to review that involves Seagal.
Most of the allegations brought forth by the plethora of Hollywood sexual abuse cases have been dropped by the specially created task force.
For most of the allegations, they fall outside of the statute of limitations.
