Halle Berry's ex-boyfriend has been granted visitation rights to their two-year-old daughter.
A judge has ruled Gabriel Aubry - who split from the Oscar-winning actress last April after almost five years with her - can spend time with little Nahla when she and her mother temporarily move to New York City, where Halle will shoot new movie New Year's Eve.
The 35-year-old model will travel to New York at his own cost so he can spend all his permitted time with Nahla.
On Wednesday Halle won the right to take her daughter to New York so she could shoot New Year's Eve.
Her lawyer Neal Hersh said of the ruling: "We are pleased the judge took the time to deal with this very imminent and important issue. The judge read a great deal of paperwork and gave us time to argue. Halle is very pleased with the judge's order."
Earlier this week, the former couple called a truce in the custody battle over Nahla.
Last month, the 44-year-old actress launched proceedings to get full custody of Nahla after claiming she was concerned for the tot's welfare when she was in Gabriel's care.
But he hit back claiming she was being "irresponsible".
However, the pair have now settled their differences, with Halle allowing Gabriel more access to Nahla.
Halle had claimed she had to pull out of New Year's Eve to focus on the custody battle and while she is now going to appear in it, her original role has gone to Katherine Heigl.
