Talks between Peter Yealands and Oyster Bay Marlborough Vineyards' independent directors have failed to head off court action.
The Seddon businessman said yesterday that he would "box on" after his legal team filed proceedings in Auckland in a bid to force the directors to disclose information that would help him decide whether to raise his bid.
"As of now no agreement has been reached so we are actively pursuing our legal options," he said.
"Time is very much of the essence and what we have to consider is that right now my offer is under a "don't sell" [recommendation] until a recommendation is made on Delegat's offer. I think that's very unjust, they are going to sit on that until the last day before they have to release it."
Mr Yealands is locked in a battle for control of the grape grower with Delegat's Wine Estate.
