Kerry Packer has won the latest round of an epic court battle with the Australian Tax Office (ATO).
After a 14-year legal battle, the full bench of the federal court upheld a decision by a single judge to set aside a decision not to extend time in which to transfer losses.
The tax in question reportedly amounts to more than A$80 million ($92 million).
The conflict began after the High Court refused to allow Packer companies to claim tax deductions for A$120 million in interest relating to loans for a takeover bid.
Deloitte tax partner Ray Conwell said the administrative law principle that the tax commissioner must consider individual circumstances had now been confirmed by the court. An ATO spokesman would not say whether there would be an appeal.
