In spite of its official line that Powdergate is ancient history, Fonterra is keeping a close on eye on proceedings in the Auckland District Court.
A lawyer from the co-operative's legal firm, Russell McVeagh, has been taking notes in court this week as Grant Waterhouse, Fonterra's regional managing director for Europe, gives his evidence.
In his cross examination of Waterhouse, defence lawyer Paul Davison, QC, established that lawyers had been briefing Fonterra witnesses and providing them with documents relevant to their testimony.
A Fonterra spokeswoman said the company's official position remained unchanged - the events took place in another era.
She said the lawyer was just there to support Fonterra staff who were required to give evidence.
A lawyer for the defence team described the situation as unusual.
