Fletcher Construction has some liability for sub-standard repair work after the Christchurch earthquakes, according to legal advice received by the Earthquake Commission (EQC).
Radio New Zealand reported that EQC head Sid Miller said the commission would now look at "the various options".
Earlier this week, Checkpoint had revealed the contract between EQC and Fletcher contained an indemnity against liability for the construction company.
Former Fletcher senior executive Mark Binns told the programme there were no grounds for a case against them.
Miller said the EQC was now assessing Fletchers' liability "as a project management office".
