KEY POINTS:
The Supreme Court yesterday dismissed an appeal from German company Henkel KgaA against New Zealand company Holdfast over copyright.
Henkel alleged Holdfast had infringed copyright in the drawing which underlay the packaging for Henkel's SuperAttak adhesive.
The court ruled Henkel was not able to appeal because of the way it had presented its original case in the High Court.
Even had it been able to appeal, the court ruled there was no breach by Holdfast of Henkel's copyright.
It said Holdfast's packaging for its UltrBonder adhesive had insufficient similarity to Henkel's SuperAttak.
Henkel was ordered to pay costs.
