The Crown has been accused of acting shamefully with an 11th-hour claim that the SIS might have more classified information than it revealed earlier on Ahmed Zaoui.
Rodney Harrison, QC, for the Algerian refugee, told the Court of Appeal in Wellington yesterday it was "totally unacceptable" for the Crown to now suggest the SIS had more information than it gave in January.
Earlier, the Crown submitted the court could not free Mr Zaoui on bail because it did not have all the data the Security Intelligence Service had about the risk he posed.
The court reserved its decision. Tomorrow it will hear an appeal by TVNZ against the High Court refusing to allow an interview with Mr Zaoui in jail.
